This website (empirehome.com.au) is owned and operated by World of Empire Pty Ltd ABN 75 676 519 047 trading as Empire Home, of 25 Port Kembla Drive, Bibra Lake WA 6163 (“Empire Home”, “we”, “us”, “our”).

By accessing, browsing or purchasing from empirehome.com.au, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website.

Shipping and returns terms for Eastern States furniture orders may differ from WA terms. Please see our separate Shipping Policy and Refund Policy for full details.

Online Orders

Thank you for shopping with Empire Home. To ensure your order and delivery runs smoothly, please read these terms carefully before completing your purchase.

It is your responsibility to review all order details at checkout, including model, size, colour, finish, price, quantity and any special requirements.

Your online order must be paid in full before we can begin supply. All credit and debit card payments are subject to validation and authorisation. If your payment is declined, your order will not be accepted and Empire Home will not be liable for any delay or non-delivery.

Payments must be made via the secure payment gateway available at checkout.

We reserve the right to charge an administration fee of 30% of the purchase total for any standard order cancelled after payment has been taken. Once goods have been dispatched, we will not accept cancellations or change-of-mind returns. For Special/Customer Orders and Pre-Orders, a 30% deposit is required at the time of ordering with the balance payable on arrival. The 30% deposit is non-refundable for change of mind. For Bespoke Special Orders, 100% of the purchase price is payable at the time of ordering and is non-refundable. Please see our Refund & Returns Policy for full terms on each order type.

Click & Collect

Click & Collect orders must be collected within 7 calendar days of the customer receiving their “Ready for Collection” notification, unless otherwise agreed by Empire Home in writing.

If you are unable to collect within this timeframe, you must contact the nominated store or Empire Home Customer Service at online@empirehome.com.au before the collection deadline to request an extension. Any extension is at Empire Home’s discretion and may not be available during major sale periods or peak trading periods.

Orders not collected within the required timeframe may be cancelled and refunded to the original payment method.

For furniture, bulky goods, sale items, or orders requiring special handling, Empire Home reserves the right to apply reasonable storage, handling or restocking costs where this has been clearly disclosed to the customer at or before the time of order and where permitted by law.

During major sale periods, promotional campaigns, warehouse sales or other peak trading periods, Empire Home may reduce or strictly enforce the collection window to manage store capacity, stock availability and order flow.

Nothing in this policy limits or excludes any rights you may have under the Australian Consumer Law.

Gift Vouchers

Purchasing a Gift Voucher

Gift Vouchers are available online or from any Empire Home store. The minimum purchase value is $50.00. Payment may be made by any method other than another Gift Voucher.

When you purchase a Gift Voucher, Empire Home will collect personal information about you and, where applicable, the recipient, including name, email, address and contact number. This information is handled in accordance with our Privacy Policy.

If ordered online, please allow 1 to 3 business days to receive your Gift Voucher. Gift Vouchers are valid for 36 months from the date of purchase.

Using a Gift Voucher

Gift Vouchers may be used to purchase goods at any Empire Home store in Australia. At this time, Gift Vouchers cannot be used to make purchases on empirehome.com.au. To redeem, present your card at the time of in-store purchase:

  • If your Gift Voucher exceeds your order total, the remaining balance will be retained on the card.
  • If your order total exceeds the Gift Voucher value, the remaining balance must be paid by another accepted payment method.
  • Gift Vouchers cannot be returned or exchanged for cash.
  • Any balance remaining after expiry will be forfeited and become the property of Empire Home.
  • Gift Vouchers are the sole responsibility of the purchaser and recipient. Empire Home is not responsible for lost, stolen or damaged cards or unauthorised use.

Product Information

We aim to ensure all pricing and product information on our website and social platforms is accurate at all times. However, web pages and older social posts may not reflect the most current details at the moment you place your order. Empire Home reserves the right to change prices without prior notice at any time before your order is dispatched.

All prices include GST at the current Australian rate, unless otherwise stated. Delivery costs are not included in displayed prices and will be added at checkout.

Wood products and products made from natural materials are sold with the understanding that each piece is unique. Colour, grain and texture may vary between pieces, samples and photographs. Natural timber may move slightly over time. Our furniture collections may have a dimensional variance of up to 3%. Screen resolution and monitor settings may also affect how colours appear online.

Warranty

Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer guarantees do not apply if you:

  • Misused the product in a way that caused the fault or damage.
  • Changed your mind about the purchase.
  • Were aware of a fault before purchasing.
  • Purchased the product for on-selling or re-supply as a business.

Empire Home Additional Warranties

The following additional warranties apply to goods purchased direct from Empire Home, in addition to your rights under the Australian Consumer Law. Structural warranties exclude surface, fabric and finish. The exclusions in the following clause apply.

Indoor Furniture (period from date of purchase)

  • Structural frame: 1 year
  • Cushions, covering fabric or leather, foam, feathers and fibre filling: 1 year

Outdoor Furniture (where specifically designed and stated for outdoor use)

  • Structural frame: 1 year (excluding normal wear and tear)
  • Covering: 1 year (excluding soiling and normal colour change due to sun, weather or coastal conditions)

Warranty Exclusions

Additional warranties above do not apply to:

  • Damage resulting from abuse, improper care or use, including failure to follow Empire care instructions, exposure to direct sunlight, salt air, chemicals, spillages or water, or use for which the product was not designed.
  • Damage resulting from failure to follow Empire care instructions or product specifications.
  • Damage incurred during the movement or relocation of a product.
  • Damage from exposure to extreme conditions, corrosive liquids or materials, incorrect cleaning, direct heat, sunlight or moisture where the product was not designed for such use.
  • Variations in natural materials (colour, grain, texture) which are not defects.

Making a Warranty Claim

To claim under any Empire Home warranty:

  1. Stop using the item immediately upon noticing a defect, and before the warranty period expires.
  2. Contact us at online@empirehome.com.au with your proof of purchase, a description of the defect, the circumstances in which it appeared, and any relevant photographs or communications.
  3. Empire Home will assess whether the product is defective and, if so, provide the appropriate remedy at its discretion.

Remedies

Where statutory guarantees apply, Empire Home’s liability is limited at its option to:

  • Replacement of the goods or supply of equivalent goods.
  • Payment of the cost of replacing or acquiring equivalent goods.
  • Repair of the goods, or payment of the cost of repair.
  • Supply of Goods

    We will dispatch your order once all items are in stock. Expected delivery timeframes vary between metro and regional areas. We usually dispatch within 5 business days of all items being in stock. Please allow up to 10 business days for metro delivery and 20 business days for regional delivery.

    If we have insufficient stock to complete your order, the relevant products will be placed on backorder. Backorder timeframes are approximate. We will keep you updated on any delays outside our control.

    Product Safety

    Empire Home encourages customers to consider the safe use and installation of all furniture to suit their individual circumstances. Please consider the placement of all furniture and homewares, particularly in homes with children or elderly residents. Toppling furniture is a safety risk.

    Some products include wall anchors or fixings in the packaging. Where these are provided, they MUST be fixed to the wall for safe use. For more information, see the Australian Product Safety Guide on toppling furniture at productsafety.gov.au.

    Events Outside Our Control

    Empire Home shall have no liability for any failure to deliver goods or any delay in doing so, or for any damage or defect caused by an event or circumstance beyond our reasonable control. We will contact you as soon as reasonably practicable if such an event occurs. Lead times and delivery estimates are approximate, and circumstances outside our control may cause delays.

    General

    Empire Home reserves the right to amend these Terms of Service at any time without prior notice. Your continued use of the website following any amendments constitutes acceptance of the updated terms. Access to the website may be restricted or terminated at any time without notice; these Terms continue to apply in those circumstances.

    These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.

    Nothing in this policy limits or excludes any rights you may have under the Australian Consumer Law.
